1. INTRODUCTION

Welcome to Fabex. These Terms and Conditions (“Terms”) govern your use of our services, including buying and selling gift cards, purchasing vouchers, and making utility bill payments via our website, mobile application, or any other platform operated by Fabex AA Global Limited (“Fabex,” “we,” “our,” or “us”).

By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not accept these Terms, you must discontinue the use of our services immediately.

2. DEFINITIONS

  • “User” refers to any individual or business entity that registers or uses Fabex’s services.
  • “Platform” refers to the Fabex website, mobile application, and any other digital interface operated by Fabex.
  • “Gift Cards” refer to digital or physical prepaid cards that users buy or sell through Fabex.
  • “Utility Bills” refer to payments made via Fabex for electricity, water, internet, mobile recharge, and other related services.
  • “Transaction” refers to any purchase, sale, or financial operation carried out through Fabex.

3. ELIGIBILITY

To use Fabex’s services, you must:
a) Be at least 18 years old or have the express consent of a parent/guardian.
b) Provide accurate, current, and complete information during account registration.
c) Not engage in any fraudulent or illegal activities.
d) Comply with all applicable laws and regulations governing financial transactions in Nigeria.

4. ACCOUNT REGISTRATION & SECURITY

4.1. Users must create an account with Fabex to access certain features. Registration requires providing a valid email address, phone number, and any additional verification details requested.

4.2. Users are responsible for maintaining the confidentiality of their account credentials and are liable for any activity conducted through their account.

4.3. Fabex reserves the right to suspend or terminate accounts suspected of unauthorized activity or fraudulent use.

5. ACCEPTABLE USE POLICY

By using Fabex, users agree NOT to:

  • Engage in any fraudulent, illegal, or deceptive transactions.
  • Provide false, stolen, or previously used gift cards.
  • Attempt to hack, manipulate, or exploit the system.
  • Use Fabex for money laundering, financing of terrorism, or any illegal purpose.

Violations of this policy may result in permanent account termination and legal action.

6. TRANSACTION TERMS

6.1. Gift Card Trading

  • Users can sell a variety of gift cards on Fabex. All submitted cards undergo a verification process before payment approval.
  • Payments are processed within a standard time frame; delays may occur due to verification procedures.
  • Fabex reserves the right to reject any card found to be invalid, already redeemed, or flagged for suspicious activity.

6.2. Utility Bill Payments

  • Users can pay electricity, internet, TV, mobile recharge, and other bills through Fabex.
  • Payments are processed instantly where possible, but delays may occur due to service provider downtime.
  • Users are responsible for ensuring accuracy in their payment details. Fabex will not be liable for losses resulting from incorrect information entered by users.

7. FEES & CHARGES

7.1. Fabex applies transaction fees on certain services. Any applicable fees will be clearly displayed before a user completes a transaction.

7.2. Third-party payment processors may also charge additional fees, which are beyond Fabex’s control.

8. REFUND POLICY

8.1. Gift Card Transactions: All gift card transactions are final and non-refundable once completed.

8.2. Utility Bill Payments: Refunds are only processed if a payment fails due to an error on Fabex’s part. If a refund is granted, it will be processed within 5–10 business days.

8.3. Incorrect Transactions: Users are solely responsible for inputting the correct details. No refunds will be issued for transactions completed using incorrect information provided by the user.

9. SECURITY & FRAUD PREVENTION

9.1. Fabex employs advanced security protocols to protect users and transactions.

9.2. Any account found engaging in fraudulent activity, chargebacks, or unauthorized transactions may be permanently banned and reported to law enforcement authorities.

10. LIMITATION OF LIABILITY

10.1. Fabex is not liable for any direct, indirect, incidental, or consequential damages resulting from:

  • User errors in transactions.
  • Service provider failures or network issues.
  • Unlawful activities conducted by third parties.

10.2. Users agree to indemnify and hold Fabex harmless against any claims, losses, damages, or expenses arising from their misuse of the platform.

11. INTELLECTUAL PROPERTY RIGHTS

11.1. All content, branding, and technology associated with Fabex are the intellectual property of Fabex AA Global Limited.

11.2. Users may not copy, distribute, or modify any part of the platform without prior written consent.

12. TERMINATION OF SERVICES

12.1. Fabex reserves the right to suspend or terminate any user account if:

  • The user violates any terms outlined in this agreement.
  • The account is involved in suspicious or illegal activities.
  • The user provides false information during registration.

12.2. Users may also request account deletion by contacting our support team.

13. MODIFICATIONS TO TERMS

13.1. Fabex may update or amend these Terms at any time. Changes will be communicated via our website or email notifications.

13.2. Continued use of our services after such modifications constitutes acceptance of the revised Terms.

14. GOVERNING LAW & DISPUTE RESOLUTION

14.1. These Terms shall be governed and interpreted in accordance with the laws of the Federal Republic of Nigeria.

14.2. In case of any dispute, users must first attempt resolution through Fabex’s customer support. If unresolved, disputes will be settled through arbitration or Nigerian courts.
